The Chamber approved at first reading with 335 votes in favor 51 against and 3 abstentions, the bill converting the Green pass School and Transport decree. The measure passes to the Senate.
The text also contains the measures relating to the reopening of schools and universities ‘in person’, reserving any ‘dad’ only for individual schools (or ‘red’ areas) and for the obligation of green certification on means of transport.
Law Decree 111 of 6 August 2021 consists of 10 articles that address some of them urgent measures to ensure not only the reopening of the school, but also of university, social activities e transport.
In particular on the school some articles address some specific issues.
The decree toarticle 1, defines the government’s priority on the development of the school year, reiterating the educational importance of the school in the presence.
Article 2 of the decree reaffirms the now consolidated safety measures until 31 December 2021, deadline for the end of the state of emergency: use of respiratory protection devices, with the exception of children under the age of six, for subjects with pathologies or disabilities and for sports activities; prohibition to enter school premises with a body temperature above 37.5 °. Finally, it is recommended to respect an interpersonal distance of at least one meter, unless the structural-logistical conditions of the buildings do not allow it.
Paragraph 3 recalls the previous guidelines to be adopted in cases of contagion at school and management of outbreaks. It should be noted that exceptions can be made in the presence of pupils who have completed the vaccination cycle or who have a valid certificate of recovery. All the problems that schools had with the health authorities last year therefore remain: priority relationships are needed between schools and the health system that allow immediate intervention for tracing, screening and identification of outbreaks. The provision does not introduce elements of strengthening of these aspects but limits itself to recalling the previous ones.
Paragraph 4 of article 1 identifies in an aggravation of the infections and therefore in a change of “color” of that territory, the only exception for which the Regions and the health authorities can establish the need for distance learning, recovering the previous rules which regulated such situations. It is understood that even in that case any further exceptions to face-to-face teaching remain for the particular needs of pupils.
Across the comma 5 the validity of indications already known is reconfirmed, article 29-bis of the decree-law 8 April 2020, n. 23, converted, with amendments, by law 5 June 2020, n. 40 and refer to the protocols signed in the various sectors and workplaces.
With the comma 6 we have the introduction of the so-called green pass. From 1 September to 31 December 2021, term of cessation of the state of emergency, all school staff of the national education system must possess and exhibit the green COVID-19 certification, or the certifications proving the state of vaccination or recovery from SARS-CoV-2 infection, i.e. carrying out a rapid molecular or antigen test with a negative result. Failure to comply with the provisions is considered unjustified absence and starting from the fifth day of absence the employment relationship is suspended and the salary is not recognized. These provisions do not apply to subjects exempt from the vaccination campaign on the basis of suitable medical certification. School administrators and those in charge of children’s educational services as well as private schools and universities are required to verify compliance with the requirements. The verification methods will be indicated by a decree of the President of the Council of Ministers adopted pursuant to article 9, paragraph 10 and further verification procedures may be established with a circular from the Minister of Education. The violation of the provisions is sanctioned with the payment of a sum from 400 to 1,000 euros.
The comma 8, establishes that no additional resources will be used to implement the provisions of paragraphs 6 and 7.
The comma 9 on the other hand, it identifies additional resources (100 million) to organize a widespread screening of the school population. Paragraphs 10, 11, 12 highlight the additional resources necessary to pay the staff who will have to replace the staff not in good standing with the green pass. These resources, also recovered within the ministry’s expense items, must be used with constant monitoring of absences. However, the resources provided cover only the period of the health emergency, until 31 December 2021.
