We will soon have more medici in Italy thanks to a historic legal victory: that for a collective redress against the limited number of admissions to the medical faculty. The State Council in fact, he recently expressed his opinion on a group of students who had appealed to be admitted to various Italian faculties, from Sapienza to the University of Magna Graecia from Tor vergata from the Bicocca of Milan to that of Florence. These students will now be able to be regularly enrolled, while until now they had attended the lessons as “conditional” members. “A historic ruling”, comments Massimo Tortorella of Consulcesi, at the helm of the pool of lawyers who assisted the students, “the Council of State admits that the number of places to enter medicine was less than needed”.
THE SENTENCE – A historic sentence for those who want to study medicine. The recent pandemic has made it even more evident to everyone how much there is a need for doctors in our country and how much the limited number over the years has limited the formation of new white coats. And the sentence 3902/21 of 20.05.2021 of the Council of State makes it clear: it definitively admits to Medicine those who have appealed, accepting the appeal against the negative sentence of the TAR which instead had blocked this registration, by virtue of the recognition of a clear general lack: that is, an inappropriate number of posts for the national needs and also specifying the legitimacy of the collective appeals that had been questioned by a minority jurisprudence.
