The UIL Scuola union has prepared an updated form on all measures regarding: Absence for administration of the vaccine, Periods of absence for quarantine, Fragile workers, Extraordinary parental leave for children, Identification and management of contacts at school.
Absence for administration of the vaccine
In case of administration of the vaccine against COVID-19, the absence from work of teaching, educational and permanent and alternate ATA staff (even short-term) is justified and does not determine any reduction in the salary (paragraph 5, of art. 31, of the decree-law n.
41/2021, converted, with modifications, by law n. 69/2021). Absences due to the after-effects of the vaccine are considered days of ordinary illness and, therefore, subject to the relative curtailments.
Periods of absence for quarantine
Until the end of the state of emergency, the period spent in sickness or in quarantine with active surveillance, or in a fiduciary home stay with active surveillance, is equivalent to the period of hospitalization and is not counted for the purposes of calculating the maximum period of
maintenance of the job in case of illness and consequently the absence cannot be counted for the purposes of the period of employment (art.87 paragraph 1 of the decree-law n.18/2020 modified by art.26 paragraph 1-quinquies, letter a of decree-law no. 104/20)
Until December 31, 2021, the protections for fragile workers in possession of recognition of disability with connotation of gravity (Article 3, paragraph 3, of Law No. 104 of February 5, 1992) or certification attesting to a condition of risk deriving from immunosuppression or from outcomes from oncological pathologies or from the performance of related life-saving therapies, which can work in an agile way and whose absence from service is equivalent to hospitalization and the relative periods will not be counted in absences due to illness (Law no. 133/2021, converting the decree-law no. 111/2021).
Extraordinary parental leave for children
Until 31 December 2021 it is possible to take advantage of extraordinary parental leave for children
(even in a state of severe disability) in cases of suspension of teaching activities in
presence of the child or in relation to the periods spent in quarantine (art.9 decree-Law 146/21,
entered into force on October 22, 2021).
Identification and management of contacts at school
With note no. 1218 of 6 November 2021, the Ministry has given indications to schools for the identification and management of contacts in cases of SARS-CoV-2 infection.
