Application rejected because beyond the deadline

What to do if the credit transfer application was rejected because it was requested after the deadline of April 15, 2021? The question was posed by a user to the Revenue Agency on the tax portal adding: “Can I enter the deduction in 730/2021 and then ask again for the transfer of the credit for the residual part?”.

The question refers in the specific case to the assignment of the tax credit deriving from the deductions due for the execution of the interventions for the recovery of the building heritage, energy efficiency, seismic risk, or for the installation of photovoltaic systems and charging columns and answer is affirmative.

In this case, for the expenses incurred in 2020, the deadline for submitting applications was in fact last April 15, but as the technicians explain, with circular no. 24/2020 the Agency confirmed that the option can also be exercised for the remaining installments of the deductions not yet used and, in the specific case posed by the question, it explains: «The option must refer to all the remaining installments and is irrevocable. Therefore, in the case indicated in the question, the taxpayer can choose to take advantage of the first deduction installment, indicating it in the 730/2021 form, and transfer the credit corresponding to the remaining installments ».

It is therefore possible to use the first installment differently from the following ones. The date of execution of the work remains essential, as recalled by the Revenue Agency: “The request for credit transfer, including that relating to the installments not yet used, can be made only if the expenses that give the right to the deductions have been incurred in the years 2020 and 2021 “.
