UDINE. The Court of Appeal of Trieste confirmed the criminal responsibility of Santo Tutino, a 70-year-old lawyer, residing in Pozzuolo del Friuli, and his eldest son Simone, a 42-year-old labor consultant, from Udine, in relation to the accusation of competition in slander against three financiers whom the Public Prosecutor of Udine had challenged them.

The deputy attorney general, Luigi Leghissa, had also concluded the discussion by asking for confirmation of the sentences. The defenders, lawyers Massimo Cescutti (for Santo) and Francesca Tutino (for his brother Simone) had instead insisted on acquittal, reiterating what they argued in the first instance. In other words, both defendants “had limited themselves to reporting the anomalous behavior of the military.”

At the center of the legal matter, the tax audit carried out by the Guardia di Finanza at the law firm in via Vittorio Veneto on 9 October 2013, and the complaints that followed to the Public Prosecutor of Udine and the Military Prosecutor of Verona to report what the defendants described as an “abusive search” and “illicit removal of files stored on PCs”. Accusations that the prosecutor Marco Panzeri considered formulated “despite knowing the innocent financiers and with a clear retaliatory imprint”.
