A compensation of 400 thousand euros for about twenty Sicilian savers induced to buy securities of the Banca Popolare di Vicenza, sold by New Bank, the island “rib” of the institute at the time led by Gianni Zonin. Four civil judgments of the Fifth section of Court of Palermo which condemned Banca Intesa San Paolo to compensate twenty shareholders. A series of decisions that give a clear imprint on the orientation of judges in favor of savers, after already last year a Justice of the Peace of Messina had sentenced the Bank to compensate a former account holder: therefore the responsibility of the credit institution that acquired New Bank.

And there are still 80 savers waiting for a decision: “We are talking about people who had set aside money to send their children to university. Among today’s winds there are those who burst into tears as soon as they heard of the sentence ”, explains the lawyer Alessandro Palmigiano which, together with Elisabetta Violante, he defended the group of Sicilian savers. Who had invested 6 thousand euros, who had invested it 40mila, but it was also those who could afford equity investments of 800 thousand euros who bought shares in the Popolare di Vicenza. All Sicilians who today obtain a first result for a story that started in 2013. Between 2013 and 2015, in fact, the subsidiaries of the Veneto Bank begin to offer standard equity packages of at least 6 thousand euros. Among the subsidiaries there is also New Bank, which has its headquarters in Palermo and branches in the rest of the island and in Calabria. The officials begin to offer the packages to Sicilian savers, selling the shares of the parent company: “Banca Nuova has sold out regardless of the danger of the stock,” explains Palmigiano. In a short time, however, the shares were practically of no value. The Venetian bank of the Zonin Group was put into liquidation shortly afterwards, with legal consequences also for the top management of the bank and with enormous damage for the customers who had purchased the products of the credit institution, who lost all their investments.

The same situation in which Sicilian savers found themselves. The first convictions arrived a year ago in Messina, when the justice of the peace agreed with a former customer of the bank. The first decisions of the judges arrive in Palermo today Rachele Monfredi ed Emanuela Rosaria Piazza on the lawsuit filed in 2017. Sono 270 thousand euros of compensation to savers e 130 thousand euros of legal fees: “The judges recognized the complexity of the legal work. My colleague Elisabetta Violante and I have grouped together some of these shareholders, thus allowing those who had invested less to proceed legally without the risk of a drain on legal costs ”. A hundred Sicilians in all defended by the two Palermo lawyers: “We are absolutely very satisfied, behind there is the experience of people who had lost all their savings. And we also feel serene about any appeal ”, concluded Palmigiano.

“The obligation that the Bank has, therefore, towards the investor must be particularly strict, the causes from which the risk derives, warn him of any inadequacy of the operation “, so underlined the judge of Messina, Santa Nastasi in May 2020, when he ordered the compensation of 5 thousand euros plus court costs for a respiarmatrice. “It was proposed to these people to make a loan with the bank to be able to participate in this operation that would have ensured them a safe investment”, underlined Ernesto Fiorillo, president of Consumatori Associati who legally supported the compensated Messina in 2020.
