The farewell to Quota 100 is getting closer and closer but there is an increasingly consolidated “name” that comes forward: it is Quota 62 which gives the possibility to retire at 62 with the expansion contract which provides for a 5-year slide with conditions charged to the employer but also with some waiver by the pensioner.

How the reform works

The Growth Decree has recently introduced expansion contracts: as anticipated, this is a pension slide initially reserved for large companies but then also extended to medium-sized enterprises that the Sostegni bis Decree also grants to companies that employ at least 100 employees. The 2021 Budget Law (L. n. 178/2020) published in the Official Gazette, for the current year only, has brought the threshold to 500 units to start reorganization and reindustrialization processes compared to the thousand provided for by the “Growth Decree” who introduced the measure, and 250 units for early retirement up to 5 years, which can only take place at certain times conditions. The Budget Law has introduced, to companies with at least one thousand employees, the possibility of being able to dismiss their workers close to retirement if they had started a process of reorganization and restructuring of processes aimed at technological improvement.

Who can access

To do this, however, you need to follow some criteria: start one procedure consultation to stipulate an expansion contract with the Ministry of Labor and Social Policies and the comparatively most representative trade union associations on a national level or with their RSAs or with the RSU. This contract can be accessed by permanent employees, apprentices and managers. Furthermore, those who adhere to the exit plan must not have more than 60 months as a time frame to accrue the pension: this means that those who are 62 years old and the company has complied with the agreements described above, can apply by next November 30th. .

Quote 100 starts eventually

Even the Sostegni bis decree published in the Gazette does not bring anything new on the pensions front except the confirmation that Quota 100 will end at the end of 2021 and there is no rule that provides for its extension. For this reason, many workers will be in serious difficulty starting from 2022 because, in fact, those who manage to reach Quota 100 in extremis by December, will be able to request the pension allowance only from the third month of maturity of the requirements for public employees and six months for private ones. Anocra more unfortunate, however, are those who for a few months or a few years will have to wait until they are 67 and work for another five. For this reason, trade unions and citizens expect urgent responses that have not yet arrived. The requests are clear: Quota 41, the proposal of the unions for greater flexibility with the request to set the retirement age at 62 and the INPS proposal to divide the allowance in two.

What is isopension

There is also an alternative to the expansion contract l’isopensione, that is the early retirement for those who until 2023 will be able to benefit from the 7-year slide. For the worker who matures the contribution or age requirements within 4 years from the termination of the employment relationship, the possibility of retiring earlier is opened: the four-year slide has been increased to seven years with the law 205/2017 in the three-year period 2018-2020. However, early retirement is granted only if there is an agreement with the employer who will pay the attendance allowance until the retirement age of the worker who decides to retire earlier is reached. In reality, the company pays monthly to INPS the sums to pay the worker the service and the related notional contribution. The benefit is not reversible, the survivors may receive an indirect pension based on the legislation.
