As we told you last December, a PlayStation user had sued Sony following the freezing of his PS5 console. The user violated the console’s terms of use by sharing PS Plus games from their library with other users. Sony had therefore activated a hardware ban of the PlayStation 5 involved. The judge of the Court of Justice of São Paulo, however, had ruled in favor of the user. Sony then appealed, but lost again.

As reported by Tecnoblog, Sony stated that the owner of the PS5 had accepted the terms of use of PS Plus and for this reason the ban was legal. Sony also claimed that the user has consciously violated the rules as the terms of use of the PlayStation Plus are “explained to consumers in a clear and crystal clear way”.

However, the user stated that, while it is true that the terms of use prohibit the sharing of PS Plus games, the rule is not explained clearly and above all it is not clearly indicated what the punishment is in case of infringement. The judge then stated that Sony was unable to give the user all the information they needed. Consequently, Sony has to lift the PS5 ban. In addition, Sony will have to compensate the user for the costs of the trial.

Still with regard to PS5, Sony evaluates several options to increase the availability of the console.
