The vaccination obligation for teachers and Ata is a reality. From 15 December, school staff will have to comply with the provisions of Legislative Decree 26 November 2021, in relation to the individual vaccination plan and within the scope of validity of the Covid 19 certification as regards the third dose.

Can anyone on parental leave, leave or sick leave be suspended?

The ANIEF union, with its own FAQ, tries to answer the question.

As established by the decree-law of 1 April 2021, n. 44, converted, with modifications, by the law 28 May 2021, n. 76, to which the DL refers, “vaccination is an essential requirement for the exercise of the profession and for the performance of the work performed by the obliged subjects”.

Therefore, those who are not on duty as of December 15 for any type of absence, parental leave, leave, sickness, are not subject to any obligation.. Until his return to service, he will not be able to receive any invitation to produce, within five days of receiving the invitation, the documentation proving the vaccination has been carried out or the postponement or exemption of the same pursuant to Article 4, paragraph 2, or the submission of the vaccination request to be carried out within a period not exceeding twenty days from the invitation.

No, for the period of parental leave see faq 3, for the Christmas holidays if I do not cover that period with absence, I am on duty and therefore subject to vaccination obligations.

Article 3 ter of the decree-law 1 April 2021, n. 44 converted, with modifications, by law 28 May 2021, n. 76, provides “ 1. From 15 December 2021, the vaccination obligation for the prevention of SARS-CoV-2 infection referred to in Article 3-ter, to be fulfilled, for the administration of the booster dose, within the terms of validity of the COVID-19 green certifications provided for by article 9, paragraph 3, of the decree-law n. 52 of 2021, also applies to the following categories
