In recent weeks we have told many stories of minors who have gone to court to be immunized despite their parents, or at least one of them, were against it. A ruling by the family section of the civil court of Milan today reverses the situation: a judge has ordered the vaccination of a 14-year-old girl who, like her mother, was against immunization. I agree with the separated father who was in favor of it. The court, tells today the Corriere della Sera, wrote in the sentence that “he does not believe to comply with the manifestation of the will not to vaccinate expressed by the girl” because in it he perceives “too close a correlation with the will of the mother, contrary to vaccination with a priori positions that completely neglect the approaches of the international science “.
Translated: the mother is No vax and for this reason the judges considered that the girl had not received correct information and therefore cannot “express a truly informed consent / dissent”. The social services of the municipality in the Milanese hinterland did not feel like forcibly vaccinating her because the anti-Covid-19 one is not mandatory. So the question returned to the court, made up of the president Anna Cattaneo and the judges Rosa Muscio and Valentina Maderna: “They asked me what I wanted to do, I heard on TV and read on the Internet that it is a new vaccine and that even if the possibility of side effects is very low. I would like to wait a little longer. I was not influenced by my mother in the decision, ”the 14-year-old said at the hearing.
But the court, following a sentence of the Cassation dating back to 2015, decided not to comply with the will of the minor. Because medical decisions, according to the court, are too complex to be evaluated by a 14-year-old boy. So the court decided to leave all the burdens on the father regarding the decision to vaccinate the child or not. But first the parent will have to “take care to inform the daughter, through specialized health personnel, of the opportunities to proceed with vaccination to protect her health, but without subordinating her to her consent”.
