The Court of Girona has stopped the proceedings for the murder of the young man from Scandicci massacred in a nightclub on the Costa Brava. The sentence was expected on November 26
The Spanish judges of the court of Girona they suspended the trial for the murder of Niccol Ciatti, the young man from Scandicci massacred on 12 August 2017 in a nightclub on the Costa Brava. The first hearing was to take place on November 26th. The decision was made after that
the German authorities had decided to extradite to Italy, at the request of the Rome prosecutor, Raoul Bissoultanov, the Chechen wrestler who hit Niccol on the ground with a terrible kick and killed him. Bissoultanov, who despite the terrible accusations also proven by a video had been placed in semilibert with the obligation to sign, had been surprised in Germany probably in an escape attempt.
The trial could be held in Italy
Now, with the suspension of the trial and the absence of the main suspect in Spain, the trial could be held in Italy. The Rome prosecutor had already requested the accused’s extradition to the Spanish judicial authorities who had denied it. Then the Chechen’s flight and Germany’s decision to extradite him to Italy. According to the lawyer of the Ciatti family, the lawyer Agnese Usai, the Spanish laws do not provide for the possibility of holding a trial in absentia, and therefore in Spain it is no longer possible to try the Chechen extradited to Italy.
Bissoultanov’s four-year pre-trial detention
There is no shortage of problems and risks. In fact, Bissoultanov has already spent almost 4 years of preventive detention in Spain and three months in Germany and therefore, even if in Italy the preventive detention can last up to six years, he could ask to return free.. In addition, in Rome the investigations are in the preliminary phase and the times are destined to lengthen also for the translation of the evidential material. The complex situation – explains the lawyer Usai – but as lawyers in this phase we have zero power. Everything that was ready for the 26th is now gone, but we will make the best defense for the family in the court that will be indicated. On who has jurisdiction to judge, the Spanish togates have asked Eurojust for an opinion, the body of the European Union specialized in the field of judicial cooperation. The decision of the body is not binding and therefore Italy could still decide to try the Chechen. Another Chechen, also accused of Ciatti’s death, he could instead be tried in Spain.
