what can be read in the draft of the guidelines for agile work, anticipated by Adnkronos, pending the green light of the Minister of Public Administration Renato Brunetta, which today at 12 presents the document to the unions. If all goes well we make it structural, the minister anticipates, explaining that smart working will be fully implementable from January 31st by the 32,000 public administrations in Italy, on the basis of the contract.
The smart will therefore be a form of work that is no longer obligatory but decided on the basis of efficiency and satisfaction, explains Brunetta, who wants to ward off the fierce but also unjust criticism hurled at the PA by remembering that all public employees during the pandemic with force, courage and risks have held the country together.
But let’s see concretely what will be the ways to carry out work as a public employee (that is, an employee of public administrations or bodies similar to them) at home or in other places other than the office. First of all, you can only use the internet connection provided by your employer to access your institution’s applications, the text indicates. If the employee has a service cellphone, calls can be forwarded from the telephone extension of his office to his work cellphone.
An important element of the guidelines concerns the right to disconnect, which coincides with the 11-hour consecutive rest period referred to in art. 17, paragraph 6, of the National Collective Labor Agreement 12 February 2018 to which the worker is required.
The public administration that wants to do smart working must then guarantee the invariance of the services provided to users but also an adequate rotation of personnel authorized to perform agile work, while ensuring the prevalence of face-to-face work for each worker. It is therefore not possible to do agile work five days a week but must alternate it with work in the office.
The administration – continues the text – it must provide for specific methods to allow the reachability of its applications remotely. If the institution’s applications can be reached remotely, or are in the cloud, the employee can easily access their main work tools from home. Alternatively, you can use the activation of a VPN (Virtual Private Network, a virtual private network that guarantees privacy, anonymity and security) to the institution, or to remote desktop access to servers.
In addition, the administration must provide management systems and protocol systems that can be reached remotely to allow the employee to work as well incoming and outgoing documents. But he must also make sure that the worker can have the right to specific training, to the protection of personal data, to the regime of permits and absences and to the compatibility with any other institution of the employment relationship and contractual provision, an indispensable clarification for smart working does not translate into availability 24 hours a day and without any protection of the rights of the worker. What limits will there be in smart working for companies? Virtually none: every administration will be able to do all the agile work it wants – said Brunetta – as long as the services are efficient and there is satisfaction of the citizens.
