The Council of Ministers has decided: starting from 15 October practically everyone will have to have the green pass. The Cdm substantially formalized what emerged from the control room which met in the morning. So the government is keeping faith with the commitment made in recent weeks, when the premier Mario Draghi it had announced its willingness to proceed with a broad extension of the green certificate obligation, moving forward gradually.
It super green pass
In the end this was the case, with the intention of extending the school model to the world of work: the decree (click here to read it) concerns workers in the public administration, in the private sector, domestic workers (such as housekeepers and babysitters) and VAT numbers. The provision also applies to all subjects who carry out (for whatever reason) their work or training activity at the administrations, also on the basis of external contracts.
Also involved in the extension of the vaccination passport are those who carry out voluntary and comparable activities. It should not be forgotten that the Parliament and the other constitutional bodies may “self-regulation” e “adapt consistently“. On the other hand, subjects exempt from the vaccination campaign will be excluded from the obligation”on the basis of suitable medical certification issued according to the criteria defined in a circular from the Ministry of Health“.
For the businesses with less than 15 employees, after the fifth day of non-presentation of the green pass, “the employer can suspend the worker for the duration corresponding to that of the employment contract stipulated for the replacement, in any case for a period not exceeding ten days, and no later than the aforementioned deadline of 31 December 2021“.
The access of personnel to workplaces without a green certificate is punished with an administrative sanction ranging from 600 to 1,500 euros. Those who do not have a green pass are considered unjustified absent. For the period of Suspension to workers “no remuneration or other remuneration or emolument, however called, is due“.
Starting from the fifth day of absence, the employment relationship is suspended until the aforementioned certification is presented and in any case no later than 31 December. They won’t be there though layoffs: there are no disciplinary consequences and the “right to keep the employment relationship“.
Pads at a reduced price
For pharmacies there is the obligation to comply with the agreement which provides for a controlled price until 31 December for tampons (8 euros for under 18s and 15 euros for all others; they will be free only for those who cannot vaccinate and for fragile subjects). In case of non-compliance, penalties are envisaged for pharmacies ranging from 1,000 to 10 thousand euros, up to the closure of the business for no more than five days. The government has accepted the request of local authorities on the extension to 72 hours of the validity of the buffer only if molecular; the fast antigenic one remains at 48 hours.
Who should check
Employers are required to verify compliance with the requirements. By October 15, they will have to define the operating procedures for organizing the checks, “even by sample“. However, where possible, priority should be given to”that these checks are carried out at the time of access to the workplace“. With a formal act it will be necessary to identify”the subjects in charge of ascertaining and contesting breaches of obligations“.
Theaters and discos
The government plans to adopt subsequent regulatory measures based on the evolution of the epidemiological situation and the progress of the vaccination campaign. For this the Technical-scientific committee to express their opinion – by September 30 – “on distancing, capacity and protection measures in places where cultural, sporting, social and recreational activities take place“.
Giancarlo Giorgetti, Minister of Economic Development, raised the theme of the reopening of the discos: the possible go-ahead will be evaluated starting from October 1st, when we will also discuss the theater, sports halls and cinemas.
