In these first days of the start of the school year 2021 2022, the teachers’ colleges have identified the areas relating to the instrumental functions introduced by the current contractual legislation and whose election, as well as the identification of the areas, pertain to the body representative of the teachers who work in each school. These figures should not be confused with the objective functions that characterized the first years of school autonomy.

Regulations and instrumental functions

The regulation of instrumental functions remains in effect article 33 of the 2006/2009 school CCNL. This rule, in paragraph 1, states: “For the realization of the institutional aims of the school in an autonomous regime, the fundamental resource is constituted by the professional patrimony of the teachers, to be exploited for the realization and management of the training offer plan of the institute and for the implementation of training projects in agreement with bodies and institutions outside the school. The resources that can be used, for the instrumental functions, at the level of each educational institution, are those which are due overall, on the basis of the application of art. 37 of the CCNI of 31.08.99 and are annually assigned by the MPI “.

Attribution criteria, number and recipients

Paragraph 2 of the aforementioned article 33 provides that these instrumental functions are identified by a resolution of the faculty board in conjunction with the three-year plan of the educational offer which, jointly, traces both the criteria for attribution and the number and recipients. It is excluded, a priori, that total exemptions from the main activity of the teacher, which is and remains teaching, are arranged on the basis of these functions. The same paragraph provides for the relative remuneration which must be defined in institutional bargaining. According to the thesis of the national association of principals, on the other hand, it would be the headmaster who, making use of the faculties of human resource management recognized by law 150/09, already has the habit of directly choosing the instrumental functions and can combine them, pursuant to of paragraph 83 of law 107/2015, in 10% of the teachers chosen by DS to train their management staff.

The CdD and instrumental functions

The Academic Board identifies, among the professional resources present within it, the figures suitable to carry out the instrumental functions for the realization and management of the Educational Offer Plan.

But what are these tasks? Always thinking in a broad sense and understanding that school autonomy guarantees the teachers’ colleges to organize the instrumental functions in a satisfactory manner in their own institute.

In order:

  • operate in the area of ​​competence envisaged by the Objectives of the area to which they belong, outside their professorship and service hours;
  • operationally analyze the related issues, including the planning ones that the Academic Board has voted on;
  • identify operational and organizational methods in agreement with the Headmaster;
  • receive specific operational proxies from the Headmaster;
  • monitor and verify every two months the achievement of the set objectives and report on his work to the Teaching Body;
  • adequately publicize the results.

Respect for collegial prerogatives

It is useful to make two important considerations:

  • Law 107/2015 has left the collegial prerogatives unchanged;
  • The CCNL school was renewed on April 19, 2018 and it was decided not to change the legislation on instrumental functions that are identified by the Teaching Body.

Basically, one of the prerogatives of the Teaching Body is to deliberate on everything concerning the didactic functioning, this is foreseen by paragraph 2, of article 7 of the legislative decree 297/94. Since the instrumental functions are nothing more than figures that guarantee a better didactic and orientation functioning, this means that the school CCNL has rightly given the College the power to identify the teachers suitable to cover these roles.

General tasks of instrumental functions

What are the tasks, then?
